Wheel Divas eV is the organizer of the international kids tour. The course of the last few years has been unfortunate. We had to cancel it in 2023 and had to resort to the courts. This is not good for Berlin, cycling or youth development. We don't just ask ourselves the question of letting go or fighting once. The arguments for both decisions are the same and both are correct. What would be possible The 30th international kids tour Berlin 2024 is scheduled to start again on the traditional weekend. The kids could start, ride and win in and around Berlin from 22nd to 25th August 2024. 1. Requirement - appointment Most of it is still open, we'll start with the basics. Rad-net as the german official organ publishes the date under recent dates and competition announcements. Registration does not mean approval. 2nd prerequisite: peaceful coexistence A consensus with the Berlin clubs is desirable. This is difficult to produce. The new statutes no longer provide for member participation in important questions in day-to-day business. So the main committee died quietly as an organ. Decisions continue to be made by President Claudiu Ciurea, his Presidium, the Board of Directors, etc. And even if there was no consensus, peaceful coexistence would be effective. The question of BRV dominance, supremacy and taking advantage of its members must also be discussed. The BRV represents the interests of its members, is not an end in itself, and does not operate itself. This is also why we are asking the Executive Board on November 14th, 2023 for a discussion date on the International Kids Tour process by January 19th, 2024. 3. Organization team The organizing team has to form. The desire to do something with another brutal expenditure of time is restrained, the history is heavy in the stomach. It will be our job in the coming weeks to assess whether we can and want to manage the event together. Above all, this means complex planning, organization and implementation. 1000 little things. 4. This takes a while. The authorities would prefer not to have a bike race. Politics and we as a sport are against this. We would like to have the kids tour in Berlin. An antagonistic-seeming contradiction. It is solvable. With qualified work by experts. 5. Finances, sponsors Last but not least, everything depends on finances. The club as organizer bears the main burden. He is supported by his sponsors. In 2022, this will make up a total of around 95%. While it was the case until 2021 that the kids tour could count on public funding, that will change in 2022. The BRV is now claiming the funding for its own event. The competition is distorted, Wheel Divas eV comes away empty-handed. We need to talk about the now missing 5%. At that time, as organizers, we obtained an interim injunction to hold the International Kids Tour. The defendants are the Berlin Cycling Association and the Association of German Cyclists. Neither wants to approve the event and the BRV even wants to prevent it. The court sees it differently and agrees with the children. The kids can start with the victory. Essentially, our president believes that the kids tour 2022 should not have taken place. It is undisputed that the tour cannot be reversed, so why the contradiction? Why a few weeks before the tour? Who or what is this supposed to be good for? Should we be boycotted? Does the BRV want to take advantage of us for its Youngster Race? With this objection, we as organizers are canceling the 2023 tour. Over 100 of the almost 200 starters switch the race from the kids tour to the youngster race Court date and verdict Our president is seeking a court date. We follow. The presiding judge invites the parties to Frankfurt/Main on Friday, October 20, 2023. At 10:45 a.m., file number 3-10 O 72/22 is called in. The question of the long period between the ruling and the objection is being intensively discussed among legal scholars. Last but not least, it is claimed that the objection was submitted so late because President Ciurea only found out about the kids tour in May 2023. We also had to correct that: It is September 15th, 2022. The evidence is presented to the judge. He dictates, asks questions and orders. Unfortunately, there is no deep understanding of the content. A pity. The absence of our president makes important answers and any conceivable consensus impossible. After 600 km of travel, this is still unsatisfactory for us. The judge closes the session. The verdict will follow next week. The court follows our request. The BRV and with it the BDR lose for the same thing a second time. The costs of the procedure, which amount to several thousand euros, are borne by the Berlin member associations from their contributions. Hard to assume that the BDR will participate? Dispute and damage Wheel Divas e.V. is currently advising in all directions. The dispute since July 2022 has resulted in a large amount of damage. The damage to the children is priceless anyway. Our own, however, can be quantified. It's about the wasted and additional effort, specifically several tens of thousands of euros. Not least due to the cancellation of the 2023 event, broken sponsorship contracts and high upfront costs. With regard to its own precautions for the 2024 season, the board of Wheel Divas eV must address the damage claims to the perpetrator, BRV, and work out a commercially effective solution. There are also arguments that go beyond financial matters. For example, who invented the kids tour? The documents say it's Jens-Holger Mey. The BRV president is against this. Who owns the rights? Whatever is right: cui bono? Who benefits from the dispute? At least not the children. “Forgotten” contradiction and forgotten mediation The BRV president submitted the objection to the court on June 21, 2023. A BRV board meeting will take place on June 22nd, 2023. The President "forgets" to inform those present. No clue anywhere. In fact, without comment, the President even accepts the task of “sitting down at the table” with us. As surprising as the contradiction was for us, it was as surprising for the entire association. The fact that more and more people now feel betrayed is only too human. The fact is, the association continues to lose. That's really bad given his tight budget. And to this day there is no conversation, no exchange, no ideas for working together. Communication is a phantom. That's too bad. The actions remain a mystery, and not just to us. Now we as a club will have to think about how we deal with the overall situation. Wheel Divas and the direction Wheel Divas continues to have a great interest in finding a consensus with the main committee and executive board. We think that an open-ended and statutory exploratory discussion with the decision-makers in the BRV is always effective. In addition to the president, the board of directors, these are, above all, the club chairmen. The 30th International kids-tour 2024 is registered. We are very proud of what we have achieved. And yet - the whole team gets a DNF, we don't take part in the sprint to the finish. Why no kids-tour? Can there be any reasons against a children's event? No. And what reason does the organising team have not to let the kids ride in the heart of Berlin, what reasons are there for our difficult step? 1. financial donation Sport, art and culture live on financial support. The sports metropolis Berlin, i.e. the Senate Department for Sport, expects the stages of the kids-tour to take place in Berlin again. Nevertheless, Berlin does not invest in kids-tour . There, too, our Berlin cycling federation is acting unhappily. It does not speak well of the kids-tour to the sponsors. Mandatory written endorsements are not issued to donors. Finally, the Landessportbund Berlin also refuses to provide financial support. The decades-long financial contribution to the kids-tour is diverted to their own event. The traditional event will once again go empty-handed after 2022. 2. Berlin cycling federation sues kids-tour The Berlin cycling federation continues to work against the national league club Wheel Divas e.V.. Currently, it is the children and the traditional event that are being hit. A discussion with us as organisers, as reported by the BRV, has not been held until today, which is why there is no time? In addition, the BRV recently filed a complaint against Wheel Divas e.V.. In the complaint, the BRV contradicts the court's decision to hold the kids-tour in 2022. The consequences for the kids and us as organisers in 2023 are? 3. can we compensate for the handicaps? Wheel Divas e.V. is one of the smallest cycling clubs in Berlin and one of the most active as a national league team, organiser and trainer of young cyclists. The demands on a complex tour are very high in a metropolis like Berlin and are constantly growing. Professional and full-time structures are necessary. Members of the organising team work on a voluntary basis, the inner circle of experts and specialists is very small. A lack of finances means that even more work has to be done by the organisation itself, and even fewer service providers. The financial capacity together with the sponsorship income of the kids-tour continues to increase excellently. Nevertheless, there are limits. A logical additional financial burden on all European teams is unreasonable. It is rejected by the board.
